Formation of Contract

The presentation of goods does not constitute a firm offer. Only if you order an item the offer becomes a definite and binding proposal according to § 145 BGB (German Civil Code). Acceptance of this proposal is stated by shipment of ordered items, by the reception of an access code, by the download of a file or by an order confirmation. With this the contract between you and us is settled.

Ordering Books, Journals, Loose-Leaf Collections and Online Information Supplies

You can select items from the wbv online shop and put them in the shopping basket. The shopping basket shows the number and prices of your items. You can change/delete items or the number of items.

After entering your customer data and selecting a payment method you need to confirm that you have read and accepted the wbv GTC (General Terms and Conditions) and Shipping Terms for Online Orders. Then you can send your online order.
After your order has been sent your order details will again be shown as a printable order confirmation.

If you have provided a valid e-mail address you will receive an e-mail order confirmation which you can download onto your computer for saving and printing.
When registering for online information supplies you will receive an access code which will enable you to access the selected type of information for an agreed period of time.

Ordering Download Files and E-Books

You can select items from the wbv online shop and put them in the shopping basket. The shopping basket shows the number and prices of your items. You have the option of changing/deleting the number of items.

Please be aware that wbv can only process payments for downloading files and e-books if you pay by PayPal (electronic payment system). After entering your customer data and selecting a payment method you need to confirm that you have read and accepted the wbv GTC (General Terms and Conditions) and Shipping Terms for Online Orders. Then you can send your online order.

After your order has been sent your order details will again be shown as a printable order confirmation.

If you have provided a valid e-mail address you will receive an e-mail order confirmation which you can download onto your computer for saving and printing.

After the order has been confirmed the download will be started or a download link will be sent to your e-mail address. This link will enable you to download a certain number of the selected file within a certain period of time.

When purchasing an e-book the customer does not gain ownership or property rights but only a license. Please take note of the copyright regulations in paragraph XIII section 1 of the wbv GTC  AGB.

Correcting Errors

Before you send your order you can finally check and amend the data you have entered (address, payment method, different delivery address as required) on the shopping basket page.

Storing Order Data

In accordance with our data protection statement Datenschutzerklärung your order data will be stored. Personal data will not, under no circumstances, be passed on to third parties.

We sell some of our items on behalf and on account of the “DIHK-Gesellschaft für berufliche Bildung - Organisation zur Förderung der IHK-Weiterbildung mbH“, Adenauerallee 86, 53113 Bonn (DIHK-Bildungs-GmbH), a chambers of commerce organisation for vocational/further training. The items are labelled accordingly. W. Bertelsmann Verlag is legally entitled to accept and process your order including any relating declarations.

Your Rights After Making the Contract: Liability for Defects and Right of Withdrawal

You have the right of withdrawal from the contract and, if applicable, the right to make a claim. In the following both rights are explained in more detail.

Liability for Defects (Claim)

If defective goods are delivered you can, according to the regulations for supplementary performance (§ 439 German Civil Code), choose between subsequent improvement and substitute delivery. Only if this supplementary performance has failed are you entitled to withdraw from the sales contract (§§ 440, 323 and 326 Section 5 German Civil Code) or to reduce the purchase price (§ 441 German Civil Code). Apart from this you can, if regulations apply (§§ 440, 280, 281, 283 and 311a German Civil Code), make a claim for compensation (refund for unsatisfactory/failed/inadequate delivery of goods/products/services or refund of advance payments if the contractor has not fulfilled his obligations – according to §§ 440, 284 German Civil Code). Warranty for defect claims expire after two years according to § 438 Section 1 No. 3 German Civil Code.

Right of Withdrawal and Cancellation Policy

Consumers have a right of withdrawal subject to the following stipulation. In this context 'consumer' means any natural person carrying out a legally binding transaction which is not predominantly part of their trade or free-lance business.
The right of withdrawal is explained in paragraph IV of our General Terms and Conditions (GTC) AGB.

Cancellation Policy

You have the right to withdraw from this contract within 14 days and without the obligation of giving any reasons.

The deadline for withdrawal is 14 days from the date 

  • when, in case of several deliveries or downloads, either you or a third party, who you have personally named and who is not the carrier, have taken ownership of the last delivereditem or download file;
  • when either you or a third party, who you have personally named and who is not the carrier, have taken ownership of the first delivery of a subscription.

If both options apply the deadline is valid from the date when either you or a third party, who you have personally named and who is not the carrier, have taken ownership of the last delivered item or the last part of the delivery or the last delievered piece in a series of goods.
In order to exercise your right of withdrawal you need to inform us by stating clearly (for example, by post, fax or e-mail) your decision to withdraw from this contract. You can use the accompanying 'Declaration of Withdrawal' form (optional).

You can complete the 'Declaration of Withdrawal' form online Widerrufsformular or state your declaration otherwise electronically on our website Website. If you take this option we will promptly respond with confirmation that we have received your declaration of withdrawal (e.g. by e-mail).

In order to comply with the deadline it is enough to send the declaration of withdrawal before the deadline expires.

The right of withdrawal does not apply if the contractor has to deliver items which have been produced according to customer specifications or have been customised to his personal requirements. Neither does the right of withdrawal apply if single issues of journals are to be delivered.

Consequences of Withdrawal

If you withdraw from this contract we will have to return promptly all payments which we have received from you including delivery charges (except additional costs arising from you chosing a delivery option which is different from the cheapest standard delivery offered by us) within 14 days starting with the date when we have received your declaration of withdrawal. For this refund we will use the same payment method which you have used for your original transaction unless agreed otherwise; this return payment will not be charged in any way. We reserve the right to withhold the refund until we have received the returns or until you can provide evidence that you have posted the returns whichever is the earliest.

You have to return or hand back the goods promptly but not later than 14 days from the date when you inform us of your withdrawal from this contract. In order to comply with the deadline you need to send the goods before the period of 14 days has elapsed. You are required to meet the immediate costs of returning the goods. The obligation of returning goods does not apply to the withdrawal from contracts concerning digital content which has not been delivered on a data storage device.

You will only be required to compensate for loss of value if this loss results from you handling the goods in inappropriate or unnecessary ways when checking the condition, properties and functions of the goods.
